- I think 'defendant' is a term that is be used in both criminal and civil proceedings. They are the opposite, as it were, to the plaintiff (civil) or victim (criminal). In civil proceedings, the plaintiff would make the complaint and bring the case to court; the victim, in criminal proceedings, has had criminal action taken against them. It is the duty of the courts, lawyers, police etc. to ensure that justice is carried out, and therefore, the victim brings the case to the court, often alongside the state or police in order to prosecute the defendant. The defendant can 'defend' themself/ves as well. It is the 'job' of the court/judge etc. to order the right punishment if that defendant did commit the act, or ensure justice is done in some other way.
